Western Cape, South Africa – In a recent development, Anton Bredell, Western Cape Minister of Local Government, Environmental Affairs, and Development Planning, emphasized the importance of adhering to legal frameworks in municipal appointments. The judgment declaring Ombali Sebola’s appointment as Knysna’s Municipal Manager null and void serves as a stern warning to councils neglecting legal protocols during appointments in municipalities.
Minister Bredell stated, “This judgment reaffirms the rule of law and reinforces our interpretation of legislation governing municipal appointments. It’s regrettable that legal recourse is sometimes necessary, but the ramifications of having unqualified individuals in critical municipal roles are significant.”
Highlighting the prolonged legal battle, Minister Bredell expressed concern over the detrimental effects on service delivery in Knysna due to the appointment dispute. “While we pursued justice, Knysna suffered from a lack of basic services, and officials prioritized personal interests over public service,” he added.
The legal proceedings commenced on March 22, 2023, when Minister Bredell sought to nullify Sebola’s appointment, citing violations of the Local Government: Municipal Systems Act 32 of 2000 and the Regulations on Appointment and Conditions of Employment of Senior Managers. Despite prior warnings to the municipality, legal action became necessary when compliance was not achieved.
The court ruling highlighted procedural flaws, including the absence of critical candidate information during the appointment decision. Council members lacked access to vital documents, such as the appointee’s CV and competency assessment scores. Moreover, essential qualifications and disciplinary records were not adequately provided, as required by regulations.
Minister Bredell stressed the urgency of effective consequence management to avoid prolonged legal battles and associated costs. He emphasized the need for councils to prioritize compliance with legal frameworks to ensure transparent and accountable municipal appointments.
